By downloading, installing, or using Gym Bag Digital ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

The App operates entirely on your device with local data storage. No cloud services or external servers are used.

License and Use

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal device solely for your use.

Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or redistribute the App
• Remove any copyright or proprietary notices from the App
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to any part of the App

Commercial Use

The App may be used for commercial purposes (e.g., by personal trainers, gyms, fitness professionals, or other businesses). Commercial users acknowledge and agree that:

• The App is provided "as is" with no warranties, representations, or guarantees of any kind
• No support, service level agreements, uptime guarantees, or technical assistance are provided
• Commercial users assume all liability and responsibility for their use of the App in their business operations
• Commercial users are solely responsible for ensuring the App meets their business needs and complies with applicable regulations
• All disclaimers, limitations of liability, and indemnification provisions in these Terms apply equally to commercial users

We reserve the right to introduce commercial licensing terms, pricing, or usage restrictions in future versions of the App. Any such changes will be communicated through updates to these Terms. Current users will have reasonable notice of such changes, but continued use of updated versions constitutes acceptance of new terms.

User Accounts and Profiles

Gym Bag Digital does not require user accounts or online registration. All profiles are created and stored locally on your device. You are responsible for:

• The accuracy of information you enter
• Maintaining the security of your device
• All activities that occur on your device using the App

User Data and Privacy

All data you create within the App (workout logs, profiles, health metrics, etc.) is stored locally on your device. We do not collect, transmit, or store your data on external servers. Please review our Privacy Policy for complete details on data handling.

Data Responsibility

You are solely responsible for:

• Backing up your data (using the App's export feature)
• Data loss due to device failure, app uninstallation, or device reset
• Securing your device to prevent unauthorized access to your data

Health and Medical Disclaimer

Assumption of Risk

You acknowledge that:

• Physical exercise carries inherent risks of injury
• You assume all risks associated with using the App and following any workouts
• You are physically and medically able to participate in fitness activities
• You will not hold us liable for any injuries, illness, or health issues that may result from your use of the App

Intellectual Property

The App, including its design, features, content, and underlying code, is owned by the developer and is protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of all data you create within the App (workout logs, notes, etc.). By using the export feature, you can download and maintain copies of your data.

Third-Party Content

News Feed

The App includes a fitness news feed that displays content from third-party websites. We do not:

• Create or control third-party content
• Endorse views expressed in third-party content
• Guarantee accuracy of third-party information
• Take responsibility for third-party website policies or practices

Third-party content is subject to their respective terms and privacy policies.

Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be error-free or uninterrupted

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages

• Personal injury or property damage resulting from your use of the App
• Any health issues, injuries, or medical conditions arising from your use of the App
• Data loss due to device failure, app malfunction, or user error

In no event shall our total liability exceed the amount you paid for the App (which is $0 for a free app).

Indemnification

You agree to indemnify and hold harmless the developer, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights

Updates and Modifications

We are not obligated to provide updates or maintain the App indefinitely.

Termination

You may stop using the App at any time by uninstalling it from your device.

Effect of Termination

Upon termination:

• You must uninstall the App from all devices
• Data stored locally on your device will remain until you delete it

Export Compliance

You agree to comply with all applicable export and import laws and regulations. You represent that you are not located in a country subject to embargo or designated as a "terrorist supporting" country by any government.

Children's Use

The App is not directed to children under the age of 13. If you are under 13, do not use the App. If you are between 13 and 18, you may only use the App with permission and supervision of a parent or legal guardian.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
